Terms of Service.

These Terms of Service ("Terms") govern your use of Xemxi (xemxi.com). Xemxi is a trading name of Xemxi Technologies Ltd, a company registered in Malta ("we", "us"), which provides the service and is the party you contract with. By using Xemxi you agree to these Terms. If you do not agree, do not use the service.

Age requirement

You must be at least 16 years old to use Xemxi. By using the service you confirm that you meet this requirement. If you are under 16, please do not use Xemxi or provide any personal information.

What Xemxi is

Xemxi is a travel planning tool for Malta. When you generate a plan, we build it once, from our knowledge base as it stands on that date, and we show that date on your plan and on the PDF. It is a snapshot: it is not updated afterwards, it does not track changes at the venues it suggests, and it makes no bookings. That is what you are buying, and it is what we undertake to deliver.

Venue details can change after your plan is generated. We recommend confirming opening times, prices, and whether booking is needed, using the links on each stop, before you visit. Every stop links out for exactly that reason.

We use AI (Anthropic's Claude) to write the descriptions in your plan. The activities, their order, and which day they fall on are decided by our own planning engine, not by the AI.

We are not a travel agency

Xemxi is an information and software service. We are not a travel agent, tour operator, or destination management company, and we do not arrange, sell, book, or mediate any travel service. If you book anything we suggest, that booking is a contract solely between you and that provider, on their terms.

Accessibility information

Accessibility information in our knowledge base is best effort and not independently verified. Plans generated for travellers with mobility requirements lean toward easier access venues based on that information. We recommend confirming access details with venues before visiting.

Acceptable use

You agree not to:

  • Use Xemxi for any unlawful purpose or in violation of any applicable laws.
  • Attempt to circumvent any usage limits or access controls.
  • Submit input designed to manipulate or abuse the AI system (prompt injection).
  • Resell, redistribute, or reproduce itinerary output for commercial purposes without our permission.
  • Scrape or automate requests to the service.

Payments

Xemxi is free to use today. We do not currently take payments, so nothing in this section or the two that follow applies to you yet.

We are introducing a paid Premium tier. The terms below are the ones that will apply from the moment payment becomes available, and they are published here in advance so you can read them before you are ever asked to pay. They take effect for a purchase when you make it, and not before.

Premium is a one-time purchase for a specific plan. It is not a subscription, there is no recurring charge, and nothing renews. The price is shown to you before you pay, and payment is handled by Stripe.

Your right to withdraw

As a consumer you normally have 14 days to withdraw from a purchase of digital content, without giving a reason.

At checkout we ask you to tick a box confirming that you want your plan delivered immediately, and that you understand you lose that 14-day right once delivery begins. Ticking it is your choice and it is not pre-ticked. If you tick it, your right to withdraw ends when we begin delivering your plan, and we email you a confirmation of what you agreed, including the statutory withdrawal form, so you have it on record.

Until delivery begins, your full 14-day right stands. If you paid but your plan was never unlocked and revealed to you, you keep it.

You can withdraw at any time using our withdrawal form, or by telling us in your own words at support@xemxi.com. Both are equally valid, and we confirm receipt by email.

Refunds and putting things right

Losing the withdrawal right does not affect your rights if the plan we sold you is actually defective. Those rights cannot be signed away, and nothing here tries to.

If something is wrong with your plan, this is the order we work in:

  • We fix it first, free. Regenerating a day or the whole plan costs you nothing, and it is usually the fastest route to a plan you can actually use.
  • A reduction in price, in proportion to the problem, if we cannot fix it.
  • Ending the contract and a refund, where the problem is not minor.

A defect means the plan is not what we described: a venue scheduled on a day it is closed, inputs you gave us ignored, a feature that does not work. Details that changed at a venue after your plan was generated are not a defect, because the plan is a snapshot of that date, but tell us anyway and we will regenerate it for you.

Not liking the suggestions, when the plan matches what we described, does not carry a statutory refund right. We may still refund as a goodwill gesture, and we sometimes do, but that is our discretion and not something we promise in advance.

A person reviews every refund request. Nothing about it is automated. Email support@xemxi.com and tell us what went wrong. Where a refund is due, we make it within 14 days, by the same payment method you used, at no cost to you.

Intellectual property

The Xemxi name, the platform, and the underlying code are owned by or licensed to us. The itinerary content generated for you is yours to use for personal travel planning. You may not commercially republish or sell generated itineraries without written permission.

Availability

We work to keep Xemxi running, but we do not promise it will be available without interruption. We may need to take it down for maintenance, and parts of it depend on services we do not control.

Our liability to you

Where we are liable to you for a purchase, our liability is limited to the amount you paid for that plan.

This limit does not apply, and we do not exclude our liability, for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • gross negligence;
  • your statutory rights as a consumer, including the conformity rights and remedies described above. Nothing in these Terms reduces them.

If we cannot resolve a complaint

Please come to us first at support@xemxi.com. Most things are quicker to fix directly, and we would rather fix them.

If we cannot resolve it between us, you can refer the matter to the Office for Consumer Affairs at the Malta Competition and Consumer Affairs Authority (MCCAA), whose Complaints and Conciliation Directorate handles consumer complaints free of charge. Claims up to €10,000 can also be brought before the Consumer Claims Tribunal in Malta, which is designed to be used without a lawyer.

These routes are in addition to your right to go to court, and using them costs you nothing with us.

Governing law

These Terms are governed by the laws of Malta. Any disputes shall be subject to the exclusive jurisdiction of the Maltese courts, without prejudice to your rights as a consumer under the laws of your country of residence.

Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email or by a notice within the app at least 14 days before the change takes effect. Continued use of Xemxi after the effective date constitutes acceptance of the updated Terms.
